On Friday, the left-wing activist arrested for alleged involvement in the deadly Capitol riot was released without bail by a federal judge.
John Earle Sullivan was released despite the government prosecutors’ objections.
According to a Fox News report, U.S. Magistrate Judge Daphne Oberg said that prosecutors “failed to meet the legal threshold to keep him in custody as he awaits further court proceedings.”
Sullivan may have been released, but the judge ordered significant restrictions on him. He is banned from social media, had to forfeit his passport, was prohibited from possessing firearms, and must find a new job outside the social justice group he founded, Insurgence USA.
Deseret News also reported that Sullivan was placed on house arrest and was required to wear a device that would monitor his location.
He previously claimed to investigators that he was really “an activist and journalist” who went to the Capitol to document the riot. CNN’s Anderson Cooper and MSNBC’s Chris Hayes consequently interviewed him of the deadly incident.
The Justice Department charged Sullivan with multiple crimes in federal court, including the following: One count of knowingly entering or remaining in any restricted building or grounds without lawful authority
One count of violent entry and disorderly conduct on Capitol grounds
One count of interfering with law enforcement engaged in the lawful performance of their official duties’ incident to and during the commission of civil disorder
The criminal complaint against the activist alleges that he entered the building through a broken window.
It further alleges that Sullivan wore “a ballistics vest and gas mask” when inside the Capitol.
The affidavit supporting the criminal complaint explained the footage where Sullivan was seen as rioters ransacked the Capitol.
When the crowd broke the last barricade, Sullivan can be heard in the footage yelling, “There are so many people. Let’s go. This s— is ours! F— yeah,’ ‘We accomplished this s—. We did this together. F— yeah! We are all a part of this history,’ and ‘Let’s burn this s— down.”
TheBlaze previously reported that Sullivan is a rabid “anti-Trump agitator and a Black Lives Matter supporter.” He has railed against the president on social media and has promoted the hashtag #antifa on several social media posts.
